Terms of Service and Agent Platform Participation Agreement
These terms set out the rules for using PropPlace.my, including public user access, agent participation, listings, credits, AI tools, market intelligence, referrals and payments.

Important: PropPlace.my is a technology and marketplace platform. It does not provide official valuations, legal advice, financial advice, tax advice, investment advice or banking advice. Users must verify all property, legal, financial and market information independently before acting.
1. Parties And Acceptance
These Terms of Service, User Agreement and Agent Platform Participation Agreement apply to every user of PropPlace.my, including public users, property owners, buyers, tenants, agents, negotiators, agencies, advertisers and any person accessing the platform.
By creating an account, ticking the acceptance box, submitting a listing, purchasing credits, using premium features, joining a referral campaign or continuing to use PropPlace.my, you agree to these terms and the Privacy Policy.
Where a signup, checkout, listing submission, upgrade, referral, premium feature or other platform screen requires checkbox acceptance, digital confirmation or continued-use confirmation, you may not proceed unless you accept the applicable terms shown or linked at that time.
Electronic acceptance, checkbox acceptance, account creation, continued use and platform records may be used as evidence of acceptance.
2. Definitions
"Agent" means a person who registers or presents themselves on the Platform as an agent, negotiator, REN, REA, PEA, sales agent, agency representative or other property professional in Malaysia, including agencies and their representatives where the context permits. PropPlace.my profile review does not guarantee current registration, authority, agency appointment or legal capacity.
"AI Output" means any content, score, summary, report, export, recommendation, market intelligence, pricing guidance, risk flag, negotiation note, generated text, PDF, dashboard result or other output produced or assisted by AI Deal Advisor, Prop Bot or any automated or model-assisted feature.
"Package" means the specific subscription, credit bundle, credit top-up, premium feature bundle, featured listing, trial, voucher, referral benefit, promotion or campaign benefit made available by PropPlace.my from time to time, limited to the inclusions, duration, limits, eligibility rules and price stated for that package at the time of purchase, activation or grant.
"Platform" means PropPlace.my, including the website, dashboard, search, listings, agent profiles, cobroke tools, referral tools, payment flow, credit wallet, AI tools, calculators, reports, exports, PDFs, APIs, Telegram workflows, WhatsApp or email workflows, admin tools and related marketplace functions.
"Promotion" means any temporary, conditional or campaign-based offer, including discounts, vouchers, referral rewards, free trials, credit bonuses, renewal benefits, top-up discounts, package benefits or marketing campaigns.
"Materials" means listings, media, photos, descriptions, market benchmarks, past transaction references, construction cost references, AI Output, reports, exports, analytics, guides, area information, calculator outputs, messages, notifications and other content displayed, generated, uploaded or made available through the Platform.
"User" means any person or entity accessing or using the Platform, including public users, buyers, tenants, owners, sellers, agents, negotiators, agencies, advertisers, subscribers, administrators and invited users.
3. Platform Role
PropPlace.my provides property listing, professional discovery, cobroke, referral, export, analytics, AI-assisted and marketplace workflow tools for the Malaysian property market.
PropPlace.my is not a registered valuer, law firm, bank, tax adviser, investment adviser, estate agency, government agency, land office or official property authority.
PropPlace.my does not act as a party to sale, purchase, tenancy, agency, financing, valuation, legal or tax arrangements between users unless expressly stated in a separate written agreement.
4. Account Eligibility And Registration
You must provide accurate, current and complete account information and keep it updated.
Agents, RENs, REAs, PEAs and sales agents must truthfully declare their role, agency relationship, licence or registration details where applicable, and must update PropPlace.my if their status changes.
PropPlace.my may require verification documents, business cards, agency confirmation, identity checks or additional information before activating, upgrading or continuing agent features.
5. Agent Platform Participation
Agents are responsible for complying with Malaysian law, professional rules, agency policies, advertising requirements and any owner or principal instructions that apply to their listings and activities.
Agents must only advertise properties where they have authority to do so, including owner consent, agency authority or other lawful basis where required.
Agents must ensure advertisements include the required firm, registration, certification, contact and negotiator or agent details where applicable, and must not make unsupported expert, official, superior, exclusive or misleading claims.
Agents must not solicit, accept or publish property instructions where they know another firm holds an exclusive or sole agency appointment unless the client has confirmed that no such appointment remains in force or that the new instruction is lawful.
Agents must not upload fake, duplicate, misleading, expired, unauthorized, bait, unavailable, illegal or materially inaccurate listings.
Agents remain responsible for property facts, pricing, tenure, size, location, land category or approved use, restrictions in interest, State Authority consent requirements, caveats, charges, liens, rent arrears, quit rent or parcel rent, assessment, subdivision, partition, amalgamation, conversion, surrender and re-alienation status, furnishing, facilities, photos, documents, availability, ownership claims and all representations made to clients or prospects.
Agents must not harass, pressure, misrepresent, spam or repeatedly contact any person to obtain instructions, listings, viewings or referrals.
6. Listings, Media And User Content
Users must only upload listing content, photos, videos, floor plans, documents, logos, testimonials and other materials that they own or are permitted to use.
Users must not state or imply that title, ownership, tenure, land use, category of land, boundaries, access, easements, caveats, charges, restrictions, consent requirements or approvals have been verified unless they have checked proper source documents or obtained qualified professional confirmation.
Users must not publish or transmit content that is obscene, indecent, false, menacing, offensive, defamatory, threatening, abusive, harassing, fraudulent, impersonating, misleading, spam-like or intended to annoy, abuse, threaten or harass another person.
By uploading content, you grant PropPlace.my a non-exclusive licence, for so long as the content remains hosted on the Platform, to host, display, process, resize, moderate, distribute and promote that content for platform operation, marketing, listing discovery, analytics and related marketplace purposes.
This content licence ends when the content is removed from the Platform, except for reasonable backup, audit, legal, security and dispute records, and except for content already published, shared, indexed, cached, exported, promoted or distributed before removal.
PropPlace.my may on reasonable grounds, and with notice where practicable, edit formatting, hide, reject, suspend or remove content that it reasonably considers unlawful, misleading, duplicated, abusive, low quality, risky, disputed, unauthorized or inconsistent with platform trust.
7. Public Users, Buyers, Tenants And Owners
Public users, buyers, tenants and owners must independently verify property information, agent authority, ownership, title, restrictions, physical condition, pricing, loan eligibility, taxation, legal documents and transaction risks.
Users should conduct land search, title search, strata or parcel verification, restriction-in-interest checks, State Authority consent checks, caveat and charge checks, rent or assessment checks, planning/zoning checks and other official searches through the relevant land office, local authority, lawyer, bank, valuer or qualified professional before committing.
Saved listings, inquiries, WhatsApp links, recommendations, pricing indicators, owner tools and AI outputs are support features only and do not guarantee any outcome.
Owners and sellers remain responsible for authorizing any advertisement and for ensuring the accuracy of information supplied to agents or uploaded directly.
8. Cobroke And Professional Conduct
Cobroke features are provided as workflow tools between professionals. Users remain responsible for commission sharing, agency approvals, client consent, written cobroke arrangements, expiry or validity periods and dispute handling.
Users must not bypass the listing agent, contact another agent’s client without consent, interfere with another lawful agency appointment, or claim cobroke rights unless the arrangement is properly authorized.
PropPlace.my does not guarantee that cobroke opportunities, leads, viewing requests or introductions will result in a deal, commission, payment or enforceable arrangement.
PropPlace.my is not liable to compensate, indemnify, reimburse or hold harmless any user for losses, unpaid commission, fee disputes, agency disputes, client disputes, appointment conflicts, failed cobroke arrangements, failed introductions, cancelled transactions or any claim arising from reliance on or participation in cobroke arrangements.
9. Credits, Subscriptions And Premium Features
Credits are platform usage credits only. They are not cash deposits, e-money, stored value, bank balances or financial products.
Each Package is limited to the specific inclusions, usage limits, eligibility criteria, validity period and feature access expressly shown for that Package at the time it is purchased, activated or granted.
Unused credits, promotional allowances, premium trials, featured listings, subscriptions and package benefits may expire according to the package, campaign or platform rules shown at the time of purchase or grant.
Credits and benefits do not carry forward unless expressly stated. Featured placement, premium badges, exports, boosts and visibility tools may improve exposure but do not guarantee inquiries, leads, viewings, sales, rentals, transactions or income.
10. Payments, Refunds And Cancellations
Payments may be processed through ToyyibPay or other payment providers, and those providers may apply their own processing rules, fees, downtime, settlement timing and terms.
Unless expressly stated in the package or campaign terms, and except for rights or remedies that cannot lawfully be excluded under applicable Malaysian law, purchases of credits, premium features, featured listings, AI exports and subscription access are non-refundable once activated, consumed, expired, partially used or connected to fraud, abuse, payment reversal, breach of these terms or prohibited use.
If payment is successfully received but the corresponding credits, package access or paid feature is not delivered due to a verified processing error, PropPlace.my may correct the account credit, re-enable the affected feature or refund the affected amount.
Refunds, chargebacks, reversals, suspicious payments or payment failures may result in reversal of credits, suspension of features, clawback of referral rewards and account review.
PropPlace.my is not a stakeholder, client account operator or escrow service for sale deposits, rental deposits, earnest deposits or other client money. Users must handle client money through lawful professional channels and written arrangements.
11. AI Advisor And Market Intelligence Disclaimer
AI Deal Advisor, Prop Bot, report exports, pricing sheets, owner reports, investor briefs, negotiation sheets, area analytics and similar tools provide indicative market intelligence only.
They are not official valuations, professional valuation advice, legal advice, financial advice, tax advice, investment advice, banking advice, loan advice or a recommendation to buy, sell, rent, hold, finance or invest.
Outputs may reference past transaction benchmarks, user inputs, comparable listings, construction cost references, derived analytics and model-generated reasoning. These are indicative benchmarks only and may be incomplete, outdated, mismatched or inaccurate.
Outputs do not verify land title, ownership, encumbrances, caveats, charges, liens, State Authority consent, Malay Reserve or other restrictions, land category, approved use, rent arrears, subdivision, conversion, planning approval, building approval, access rights or any official land-office record.
PropPlace.my does not guarantee accuracy, completeness, future market performance, loan approval, rental yield, resale value, investment return, buyer demand or transaction success. Users must conduct their own due diligence and consult qualified professionals where needed.
12. Market Data And Third Party References
Market benchmarks may be derived from publicly available sources, user inputs, platform activity, imported transaction records, comparable listings and third party references.
PropPlace.my does not claim ownership of third party source data, does not represent that derived analytics are official government figures, and does not provide raw transaction databases for republication or resale through the platform.
References to public or third party sources are used for benchmarking and derived market intelligence only. PropPlace.my is not affiliated with, endorsed by or officially representing any government agency, land office, bank, professional body or third party data owner unless expressly authorized in writing.
13. Referral And Refer To Earn Programs
Referral rewards may include discounts, package renewal benefits, credit top-up discounts, vouchers or cash commission only when a specific campaign expressly enables the reward type.
Eligibility may require active paid package status, verified REN/REA/PEA/sales agent status, approved listings, yearly snapshot rules, qualifying referred accounts, successful payment, no refund or reversal, and compliance with campaign rules.
Self-referrals, fake accounts, duplicate identities, same IC, same phone, same payment method, same device fingerprint, suspicious patterns, misleading promotion or abuse are prohibited.
PropPlace.my may reject, suspend, reverse or claw back referral rewards for fraud, abuse, refunded transactions, chargebacks, ineligible referrals, account suspension or breach of terms. Recipients are responsible for any tax reporting or tax liability arising from rewards.
No referral program guarantees income. PropPlace.my may amend, suspend or terminate any referral campaign at any time in compliance with Malaysian law.
14. Personal Data, Privacy And Marketing Consent
Personal data is handled according to the Privacy Policy and applicable Malaysian personal data protection requirements.
Users consent to PropPlace.my processing account, profile, listing, inquiry, payment, verification, referral, analytics and communication data for platform operation, security, compliance, support, marketing and product improvement.
Users are responsible for ensuring they have a lawful basis before submitting third party personal data, client details, owner details, reviewer details, documents, photos, screenshots or private communications to PropPlace.my.
Marketing messages may be sent where permitted by law or consent. Users may opt out of non-essential marketing or withdraw consent where processing is consent-based, but operational, security, transactional, account and legal notices may still be sent.
Where PropPlace.my processes personal data on behalf of a user, agent, owner or agency, the submitting party remains responsible for providing required notices, obtaining required consent or authority, keeping the data accurate, limiting disclosure and instructing PropPlace.my only for lawful platform purposes.
PropPlace.my may verify identity before processing access, correction, deletion, portability, withdrawal or complaint requests, and may retain records where required for security, payment, legal, audit, abuse-prevention or dispute purposes.
Users must promptly notify PropPlace.my if they believe personal data submitted to or processed through the platform has been lost, misused, accessed without authority, disclosed incorrectly or otherwise affected by a personal data breach.
Where PropPlace.my becomes aware of a personal data breach that is notifiable under the Personal Data Protection Act 2010 as amended, PropPlace.my will make notifications to the Commissioner and affected individuals within the timeframes and in the manner required by law.
15. Prohibited Use
Users must not scrape, copy, bulk download, reverse engineer, spam, harass, threaten, abuse, misrepresent, upload malware, bypass controls, abuse AI usage, manipulate rankings, create fake inquiries, impersonate others or use PropPlace.my for unlawful activity.
Users must not publish personal data, confidential documents, owner details, client details or third party materials without a lawful basis and necessary consent.
Users must not misuse inquiry forms, review links, WhatsApp links, Telegram bots, email alerts, notifications or any communication feature to send repeated, unsolicited, false, offensive, indecent, menacing, threatening, abusive or harassing communications.
Users must not intercept, attempt to intercept, disclose or misuse communications, OTPs, verification links, sessions, credentials, private messages or platform data without lawful authority.
16. Suspension And Termination
PropPlace.my may on reasonable grounds, and with notice where practicable, suspend, restrict, downgrade or terminate accounts, listings, payouts, credits, premium access or referral participation where there is suspected abuse, fraud, legal risk, payment risk, professional misconduct, inaccurate information, security risk or breach of these terms.
Suspension or termination does not waive PropPlace.my rights to recover unpaid amounts, reverse credits, claw back rewards, preserve records or seek legal remedies.
17. Account Closure
Users may request account closure through the dashboard where available or by written request to hello@propplace.my. PropPlace.my may verify identity and may retain records required for security, payment, legal, audit, abuse-prevention, tax, regulatory or dispute purposes.
Account closure does not entitle a user to a refund of activated, consumed, expired or partially used credits, packages or features, or credits, packages or features connected to fraud, abuse, payment reversal, breach of these terms or prohibited use, but any recurring subscription billing controlled by PropPlace.my will stop at the end of the current paid period unless another cancellation rule is expressly stated.
18. Limitation Of Liability
To the fullest extent permitted by law, PropPlace.my, its operators, directors, officers, employees, contractors, service providers and partners are not liable, whether in contract, tort, negligence, statute, equity, restitution, misrepresentation or otherwise, for any loss, claim, damage, cost, expense, compensation, reimbursement or indemnity arising directly or indirectly from use of, inability to use, reliance on, reference to or participation in the Platform, Materials, Packages, Promotions, subscriptions, credits, cobroke tools, AI Output, listings, reports, exports, referrals, payment flows or communication features.
PropPlace.my is not liable for direct, indirect, incidental, special, consequential, exemplary, punitive or economic losses, including loss of profit, revenue, goodwill, data, opportunity, bargain, transaction, buyer, tenant, seller, owner, client, agency appointment, commission, referral reward, subscription value, financing opportunity, rental return, resale value, deposit, professional fee or business interruption.
PropPlace.my does not bear monetary, non-monetary, compensatory, indemnity, reimbursement or other liability for any loss, damage, claim, suit, summons, penalty, dispute, failed transaction, failed commission, failed investment, professional complaint or other consequence caused by a user, agent, owner, buyer, tenant, advertiser or third party, including where that person placed absolute reliance on the Platform, Materials or AI Output without carrying out prior and necessary due diligence, independent verification and professional checks.
The Platform, Materials, Packages, Promotions and functions are provided on an as-is and as-available basis. PropPlace.my does not warrant accuracy, completeness, fitness for purpose, merchantability, uninterrupted access, error-free operation, lead volume, lead quality, transaction completion, financing approval, rental return, resale value, buyer demand, agency commission, user income or any commercial result.
Nothing in these terms excludes liability that cannot lawfully be excluded under applicable Malaysian law, including liability for fraud, fraudulent misrepresentation, wilful default, or death or personal injury caused by negligence to the extent such liability cannot lawfully be excluded.
Subject to the foregoing and if any liability cannot lawfully be excluded, PropPlace.my’s aggregate liability is limited to the amount actually paid by the affected user to PropPlace.my for the specific paid Package, feature or transaction giving rise to the claim during the three months immediately before the event, excluding third party payments, taxes, pass-through charges and amounts paid to agents, owners or other third parties.
19. Indemnity
To the fullest extent permitted by law, you agree to indemnify PropPlace.my, its operators, directors, officers, employees, contractors and partners against claims, losses, penalties, costs and expenses arising from your breach of these terms, unlawful conduct, misleading listings, unauthorized content, professional misconduct, payment abuse, referral abuse or misuse of platform tools.
This indemnity includes any suit, summons, demand, complaint, investigation, damages award, settlement amount, penalty, fine, professional disciplinary issue, chargeback, refund, reversal, legal fee, collection cost and administrative cost that PropPlace.my is required to pay, suffer or respond to because of your listing, communication, transaction, cobroke arrangement, referral activity, reliance on platform materials, failure to conduct due diligence, breach of law, breach of agency duty, lack of authority, inaccurate information, unauthorized use of personal data or dispute with another user, client, owner, agent, agency, buyer, tenant, authority or third party.
This indemnity does not apply to the extent a loss is caused by PropPlace.my’s own fraud, wilful default, ordinary negligence or liability that cannot lawfully be excluded.
PropPlace.my may withhold credits, suspend access, reverse benefits, claw back rewards or set off amounts owed where a user’s conduct exposes PropPlace.my to actual or reasonably anticipated claims, losses, damages, settlements, penalties, legal costs or regulatory risk.
20. Force Majeure
PropPlace.my is not liable for failure or delay in performance caused by events beyond its reasonable control, including internet or hosting outages, telecommunications failure, payment provider failure, third party service failure, cyber incidents, security attacks, data centre issues, power failure, natural events, pandemic, labour disruption, legal or regulatory change, government action or other events outside reasonable control.
21. Changes To Terms
PropPlace.my may update these terms from time to time. Non-material changes may be notified through the website, dashboard, email, WhatsApp, Telegram or other platform channels, and continued use after such updates means you accept the updated terms.
For material changes that materially affect fees, package scope, refund rules, liability, indemnity, personal data rights, agent obligations, referral rewards or other important user obligations, PropPlace.my may require active acceptance, for example a new acceptance tick box, before the changes take effect or before affected features continue.
22. Governing Law, Disputes And General Terms
These terms are governed by the laws of Malaysia. The parties should first try to resolve disputes in good faith through platform support or written communication to hello@propplace.my. WhatsApp support at +60178671679 may be used for operational convenience, but formal notices, privacy requests, disputes and legal communications should be sent by email. Subject to any mandatory law, the courts of Malaysia have exclusive jurisdiction over disputes arising from or relating to these terms or the Platform.
If any provision or part of these terms is held to be illegal, invalid, void or unenforceable, that provision or part will be treated as modified or severed only to the minimum extent necessary, and the remaining provisions will continue to bind the user and remain in full force and effect.
Any liability, right or remedy that cannot lawfully be excluded is limited to the minimum extent permitted by applicable law and does not affect the enforceability of the remaining exclusions, limitations, indemnities and user obligations in these terms.
Clauses on limitation of liability, indemnity, content licence, intellectual property, payment obligations, privacy, audit records, governing law, dispute handling and any provision that by its nature should survive will survive termination of these terms or a user’s account.
These terms, the Privacy Policy and any applicable package, campaign, payment or feature terms form the entire agreement between the user and PropPlace.my for platform use. A failure or delay by PropPlace.my to enforce any provision is not a waiver of that provision.
PropPlace.my may assign, transfer or novate these terms to a successor, affiliate, purchaser or operator in connection with a merger, acquisition, restructuring, financing, sale of assets, business transfer or platform transfer. Users may not assign their rights or obligations without PropPlace.my’s written consent.
